Appeal from a judgment of the Supreme Court at Special Term, entered November 3, 1975 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, seeking to be permanently restored to his civil service position. Petitioner commenced his employment with the State on May 30, 1974 as chief scientist (biology) with the science service under the Education Department.
