This is an action to recover damages for the death by drowning of John A. Curtió in a swimming pool maintained by the defendant in a building known as the Public Baths on the corner of President street and Fourth avenue in the borough of Brooklyn, New York. The case was tried before the court without a jury, and resulted in a verdict for the defendant dismissing the complaint. The Appellate Division, second department, reversed the judgment of the Trial Term on the law and the facts and granted a new trial, one justice dissenting.
