This was an action brought by the plaintiff in error, plaintiff below, ag’ainst the defendant in error, insurance company, defendant below, upon the total disability clause of a g’roup policy contract of insurance carried by the plaintiffs’ employer, and was based on a heart condition which allegedly caused him to be totally and permanently disabled within the meaning of the contract. The parties hereinafter will be designated as plaintiff and the insurance company.
