Respectfully, I do not agree that the en banc opinion of the Commonwealth Court in this matter should be affirmed per *663curiam. Instead, an order reversing that Court is warranted, with instruction that this Court’s decision in Schrankel controls.1 Therefore, I must dissent.
This matter involves the Driver’s License Compact, 75 Pa.C.S. §§ 1581-1586, in particular suspension of a driver’s license based upon a driving under the influence (DUI) offense and conviction in the state of New York.
