The defendant, Robert Zmayefski (defendant), appeals from his conviction for the breaking and entering of a dwelling in violation of G.L.1956 § 11-8-2; resisting arrest in violation of G.L.1956 § 12-7-10; and possession of marijuana in violation of G.L.1956 § 21-28-4.01(c)(l)(2)(ii). This case came before the Supreme Court for oral argument on September 24, 2003, pursuant to an order directing the parties to appear and show cause why the issues raised in this appeal should not summarily be decided.
