I.INTRODUCTION
The Court has before it Defendant Municipality of Orocovis’ “Motion to Dismiss” (docket No. 12) and Plaintiffs’ opposition thereto (docket No. 25).
The present action is premised on an alleged motor vehicle accident which occurred on February 15, 2003 and resulted in the demise of Carlos Javier Burgos Santiago. Plaintiff Sonia Garcia asserts a personal cause of action as a result of the death of Mr. Burgos Santiago.
