This case comes to this court on appeal on questions of law from the Court of Common Pleas of Hamilton County, Ohio. The cause of action grew out of a judgment obtained by plaintiff against defendant in the state of Florida. The plaintiff had painted posters for the defendant, who had been doing business under the name of Davenport’s Merchants Free Circus. When the circus ceased to operate under the latter name, defendant “took” certain property as his share of the circus assets.
