This appeal comes from a decree vacating and setting aside a divorce decree issued at a former term of the chancery court. W. P. Dengler sued Minnie Mae Dengler for a divorce on the ground of desertion. Summons was issued and served and return made thereon for more than twenty days before the case came on for trial. The defendant did not appear, and on the 29th day of January, 1937, decree was entered. There is no-question about the regularity of the decree in all respects.
