STATEMENT OF THE CASE

Plaintiff-appellant, Robert Stanley, appeals from a decision granting a motion for judgment on the evidence in favor of defendant-appellee, William Fisher, D. 0.; and from a jury verdict entered in favor of the defendant-appellee. We reverse and remand.

STATEMENT OF THE FACTS

Robert Stanley (Stanley), after deciding to have a vasectomy, contacted Dr. William Fisher (Fisher). On February 20, 1976, Fisher performed the vasectomy in his office. The procedure lasted about one to one and one-half hours. Fisher used the bilateral incision method which entails…
