The plaintiff, Brendan Cunney (“Cunney”), seeks compensatory damages in the amount of three million dollars from the Village of Grand View-on-Hudson (the “Village”) for an alleged violation of his constitutional rights guaranteed by the First and Fourteenth Amendments. The Village moves to dismiss Cunney’s complaint. Although the Village labeled its motion as a motion to dismiss, both parties refer this Court to exhibits beyond the four walls of the complaint.
