The plaintiff in error, hereinafter called the defendant, was convicted of the crime of selling whisky to> a minor, and sentenced to pay a fine of $2,000 and be confined in the penitentiary for 5 years. Motion for new trial was filed, considered, and overruled, and the defendant reserved an exception and has appealed by petition in error and case-made to this court.
