WINDES, Justice.

Appellant, Tucson Warehouse & Transfer Co., Inc., a corporation, as plaintiff, filed a complaint against appellee, Al’s Transfer, Inc., a corporation. The parties will be referred to herein as plaintiff and defendant. The complaint sets forth in substance the following facts: That on August 8, 1949, the Arizona Highway Department, Division of Motor Vehicles, pursuant to the provisions of section 66-520, A.C.A.1939, notified the Arizona Corporation Commission to revoke a certificate of convenience and necessity theretofore issued to one W.
