In this action the appellee, as plaintiff, sued James M. Crandall, Robert Crandall and the appellant, as •defendants, in a complaint of «three paragraphs, upon a promissory note, of which the following is a copy:
“ $600. New Castle, Ind., March 9th, 1876.
“ Six months after date we promise to pay to the order of George Hazzard, or bearer, at Citizen’s State, of New ’Castle, Indiana, six hundred dollars, with ten per cent, interest after date, and attorney’s fees if suit be instituted •on this note, without any relief from valuation or appraisement laws.
