Several assignments of error are based on the ruling of the Circuit Judge in either receiving or *450rejecting testimony which was offered by the respective parties, and while it appears from the brief of the .appellants that these assignments' are insisted on, we q'o not think it can be said they are argued here. We will say however, that from a casual examination we do not think any of these affect the real merits of the controversy.
