This is an action to recover a part of the consideration paid on a land contract after an alleged rescission thereof by the plaintiff. On the 21st day of September, 1914, plaintiff and defendant entered into a written agreement for the sale by defendant to plaintiff of certain lots in the city of Milwaukee for the price of $21,600.
