The plaintiff in error, hereinafter referred to as the defendant, svas convicted of having choctaw beer, with intent to sell, barter, give away, and otherwise furnish the same in violation of the prohibitory Jaws, and was sen fen cod to'pay a line of $125. and be imprisoned in the county jail for 30 days. Prom the judgment, the defendant has appealed to this court.
The testimony on behalf of tlie state is, in substance, as follows:
