FOLLAND, Chief Justice.

This case is here on second appeal. The decision on first appeal is to be found in 89 Utah 347, 57 P. 2d 708. Reference is hereby made to that case for a detailed statement of the facts. On second trial, the cause was tried by the court sitting without a jury. The trial court made findings of fact, conclusions of law, and entered judgment for the defendants, no cause of action.
