In Banc. By indictment returned in the circuit court for Jackson county on February 2, 1931, the defendant was charged with the crime of murder in the first degree by shooting and killing one Sam Prescott in Jackson county on January 24, 1931. Upon arraignment he entered a plea of not guilty. He moved the court for a change of venue, which motion was denied. As a result of the trial, the jury returned into court a verdict finding the defendant guilty of the crime of murder in its highest degree, without recommendation.
