This suit was filed by defendants in error, Ethel Brown and husband, Guy C. Brown, against the First National Bank of Rosebud, to recover of said bank certain rents alleged to havq been deposited in said bank by J. T. Richardson, a tenant of defendants in error, Ethel and Guy Brown; and it was further alleged, in substance, that by agreement of all parties interested in said rents, as shown by two checks of J. T. Richardson to the Browns, and other evidence, said bank agreed to turn over to the said Ethel Brown and Guy C. Brown said rents, when the release of a garnishment proceeding by said-…
