Tbe appellant sought by mandamus proceedings: to compel tbe Comptroller of tbe Treasury of tbe State of Maryland, tbe appellee, to issue to' bim a license, under tbe provisions of Chapter 828 of tbe Acts of 1914, for a purse or buck net to be used exclusively for catching a species of non-food fish called menhaden. Upon trial before tbe Court without a jury, tbe petition was dismissed and from that order, this appeal was taken.

Chapter 828 of tbe Acts of 1914, amending Chapter 140 of tbe Acts of 1908, provides:
