Appeal by the defendant, Fritz Leopold Schmidt, Jr., from an interlocutory judgment of the Supreme Court in favor of the plaintiff and certain of the defendants, entered in the office of the clerk of the county of Kings on the 3d day of July, 1907, upon the decision of the court rendered after a trial at the Kings County Special Term.

Many were the questions and difficult their character which were submitted to the learned trial court for its determination upon the hearing of this case. Although the record is exceedingly voluminous, yet by the terms of his requests to find, his exceptions, his notice of appeal and the points he urged upon the argument, the appellant invites our consideration of but one substantial question, and this has to do with the construction of a certain part of the 1st paragraph of the will of George P.
