The facts of this case, as they are stated in the paper-books, are, substantially, as follows: The last will and testament of Francis Funk, deceased, was executed May 27,1872 ; at that *450time, he had a wife; two sons, Francis and Frederick; a married daughter, Mrs. Fourgeray, and an unmarried daughter, Mary U. Funk, the appellee. ■ A. J. Quin, who was a lieutenant in the British army until 1873, in that year visited this country, and then first made the acquaintance of Mary U. Funk, who became his wife in 1875.
