MEMORANDUM-DECISION AND ORDER

I. INTRODUCTION

On February 14, 2001 and March 4, 2002, pro se plaintiff Douglas E. Kampfer (“Kampfer” or “plaintiff’) commenced the instant actions, pursuant to 42 U.S.C. § 1983, alleging that the defendant New York State Trooper William VonderHeide 1 (“VonderHeide” or “defendant”) violated his rights under the First and Fourteenth Amendments.
