This is an appeal from a summary judgment. W. Thomas Bolton, plaintiff (appellant herein), filed suit in the District Court of Panola County, Texas, on May 27, 1964, seeking a recovery of damages against defendants, Alton Coats, Olin Mathieson Chemical Corporation (Mathie-son), Humble Gas Transmission Company (Humble), Hurley Petroleum Corporation (Hurley), Tennessee Gas Transmission Company (Tennessee), and Champlin Oil & Refining Company (Champlin).
