MEMORANDUM AND ORDER
CANNELLA, District Judge:
Defendant’s motion for summary judgment with respect to the issues of laches, barring plaintiff from seeking or recovering damages for alleged infringement prior to the commencement of this action, is granted. Fed.R.Civ.P. 56.
BACKGROUND
Plaintiff Olaf Soot, a consulting engineer, holds U.S. Patent 4,034,227, filed on February 2,1976 and issued to Soot oh July 5, 1977 [the “227 Patent”], and U.S. Patent 4,088,897, filed on January 19, 1977 and issued to Soot on May 9, 1978 [the “897 Patent”] [collectively the “Soot Patents”].
