This action was instituted in the District Court for Carbon County by Isaac C. Miller, against Cosgriff Brothers, a partnership composed of John B., Thomas A. and James E. Cos-griff. It is an action for damages for an alleged trespass upon certain lands leased by the plaintiff from the Union Pacific Railroad Company, and there was also a prayer for an injunction pendente lite restraining a continuance of the trespass, and that at the final hearing the injunction be made permanent.
