SUPPLEMENTAL MEMORANDUM AND ORDER

The plaintiff has filed a Motion to Alter or Amend (Docket No. 103), to which defendant TVA has responded in opposition (Docket No. 106). For the reasons discussed herein, the plaintiffs Motion will be granted, and the portion of the court’s December 6, 2007 Order granting judgment to the plaintiff in the amount of $2,159,153.00 compensatory damages will be modified as set forth herein.
