The United States appeals the district court’s order granting a new trial and its denial of the government’s motions for reconsideration of its order granting a new trial and to enforce the recusal of Chief Judge Morey L. Sear following the convictions of Michael O’Keefe, Sr., Eric Schmidt, John O’Brien, Gary Bennett, and Paul Schmitz (collectively “O’Keefe”). We vacate the order granting a new trial and remand to the district court to consider O’Keefe’s remaining arguments, as yet unaddressed, for new trial. We deny the government’s request to remand this case…
