OPINION AND ORDER

KING, District Judge.

Plaintiffs Arkady Aginsky and Sharlota Aginsky 1 claim defendant Farmers Insurance Exchange (“Farmers”) breached an insurance contract. Before me is Farmers’ Motion for Summary Judgment (# 8). For the following reasons, I grant Farmers’ motion for summary judgment.

BACKGROUND

On November 27, 1996, Farmers issued a property insurance policy to cover an apartment building owned by the plaintiffs. At the time the policy was issued, the apartment had in place a permanent roof. In early 2003, plaintiffs decided to re-roof one of their three apartment buildings…
