The appellee was arrested on February 28, 1935, near Bellefonte, Centre County, by a state highway patrol man and charged with operating an automobile in a reckless manner. Immediately following his arrest he was examined by the physician of Rockview Penitentiary and found to be under the influence of intoxicating liquor. He was then charged with drunken driving before a local justice of the peace, and posted bond for his appearance at the next term of court.
