Plaintiff, Nicholas Kambylis, filed a complaint against defendant, Ford Motor Company, asserting a claim on a products liability theory for injuries he sustained in a car accident when he hit another vehicle from the rear while driving a 1995 Ford Escort (Escort). Plaintiff asserted that the vehicle was defective because the air bag failed to deploy upon impact, thus enhancing his injuries. After the accident, the Escort was towed and was eventually destroyed by the City of Chicago’s automotive pound.
