Lack of frankness in discovery can have unintended and sometimes damaging consequences. This is a consolidated securities fraud action brought by the purchasers of preferred stock or senior notes of WRT Energy Corporation (“WRT”). Because WRT filed for protection under Chapter 11 of the United States Bankruptcy Code and was subsequently discharged in bankruptcy, it is not a named defendant.
