George Bashara brought this action against Black Hills Corporation (“Black Hills”), alleging that he had been terminated on the basis of his age, in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. §§ 621-634. Following extensive discovery, Black Hills moved for summary judgment. The district court 1 found that Bashara had been terminated as part of a legitimate reduction in force and that Bashara therefore had to show, as part of his prima facie case, that age was a factor in his termination.
