*786OPINION OF THE COURT

COOK, Judge:

In conformity with his plea, appellant was convicted by general court-martial of aggravated arson in violation of Article 126, Uniform Code of Military Justice (10 U.S.C. § 926). The approved sentence is indicated above.

On 11 May 1975, in conjunction with a Private Anderson, appellant journeyed to The Western Club for what turned into an evening of libation. The club was located at 31 Bahnofstrasse, Baumholder, Germany, on the ground floor of a two-story building. The top floor contained five rooms which were rented as apartments.
