Relator has appealed from an order of the county judge of Clinton county dismissing a writ of habeas corpus and remanding him to the custody of the warden of Clinton Prison. The facts are undisputed.
On March 20, 1930, relator, with four others, was indicted by a grand jury in New York county for the crime of murder in the first degree. On April 2, 1930, relator was arraigned on such charge in the Court of General Sessions and entered a plea of not guilty to the indictment.
