My Associates have concluded that we erred in reversing and remanding this case. Not being able to agree with 'them, I deem it proper, on account of the importance of the issues involved, to state the grounds of my dissent.

The majority opinion is based, in part, upon the theory that/title to the land in controversy had its inception when Berry Bishop was a single man, and was therefore his separate property. T¡his conclusion is based upon the fact that Bishop made a contract with his mother to purchase the land from her before his marriage, and the recital in the deed of love and affection.
