This action arose out of a collision between two motor vehicles. Each party sought a recovery for injuries alleged to have been caused by the negligence of the other and each denied any negligence on his own part. Upon the trial’ of the case the jury returned a verdict for dismissal of the action and judgment was entered in accordance with the verdict. Plaintiff thereafter moved for judgment notwithstanding the verdict or, in the alternative, for a new trial.'- This motion was denied in both its phases and plaintiff has appealed both from the order denying the motion and from the judgment.…
