Christianson, Justice.

This action arises out of a head-on collision between an automobile owned by defendant Yernon C. Nelson and operated by defendant Kenneth E. Nelson, as his agent, in which plaintiff was a passenger, and an automobile owned and operated by defendant Frank Anselmo. Plaintiff had a verdict against all defendants. From an order denying his alternative motion for judgment or a new trial, defendant Anselmo appeals.
