Plaintiff’s husband took out a policy of life insurance in the defendant company payable to her and thereafter died. Defendant refused to pay and plaintiff instituted an action to recover the amount named in the policy. A trial was had before the circuit court with the aid of a jury. At the close of the evidence defendant asked the court to give a peremptory instruction directing a verdict for it. The court refused to do so and it excepted. Plaintiff thereupon asked for a peremptory instruction directing a verdict for her, which the court gave, and defendant again excepted. The jury returned…
