This suit was instituted by defendant in error, as trustee for the Imperial Sugar Company, and such trustee will hereinafter be called plaintiff and the Imperial Sugar Company will hereinafter be called company, in the district court of Ft. Bend county, against Burleson & Baker, a partnership, hereinafter called defendants, to recover for loss on a shipment of 720 bags of sugar, shipped by the company to the defendants under a contract of sale by the company to the defendants, which the defendants refused to receive.
