OPINION
GREENAWAY, District Judge.
This matter comes before the Court on Plaintiff Corky Balias’ (“Plaintiff’) motion to remand this matter to the Superior Court of New Jersey or alternatively to dismiss pursuant to Fed.R.Civ.P. 12(b)(1). 1 Also before the Court is Defendants Gennaro Tedesco’s and Ballroom Blitz Music’s (collectively “Defendants”) motion seeking (1) a temporary restraining order, (2) a preliminary injunction and (3) to vacate the December 11, 1998, order of the Superior Court of New Jersey. 2 This Court heard oral argument on those motions on January 29, 1999. 3 For the reasons…
