Perini/Tompkins Joint Venture (“PTJV” or “Appellant”) appeals the district court’s grant of summary judgment in favor of ACE American Insurance Co. (“ACE” or “Appellee”). PTJV filed suit, claiming coverage under primary and excess insurance policies with regard to a large-scale construction project in Oxon Hill, Maryland.
