STEELE, District Judge.

This matter is before the Court on the motion for summary judgment filed by defendant Lexington Insurance Company (“Lexington”), and on the plaintiffs motion for partial summary judgment. (Docs. 105, 106). The parties have filed briefs and evidentiary materials in support of their respective positions, (Docs. 105, 107-09, 138-42, 145, 152), and the motions are ripe for resolution.
