This cause involves the same questions presented to the court in the case of Nicholas and William Sauer v. J. W. McMurty, as a tax payer and county attorney of Roger Mills county, and was consolidated with this one for the purpose of argument before this court.
The question in the Pawnee county case comes to this court by the petition in error of holders of warrants issued subsequent to the first assessment, who claim to be prejudiced by the action of the district court of Pawnee county, excluding warrants issued since the assessment in excess…
