Pearson, Vice-Chancellor:

Defendant owns a horse racing park which it operates under a license from the Delaware Racing Commission. At race meetings during the years 1937 through 1940, pursuant to its license, it “conducted and sold pools by the use of a ‘totalizator,’ for the purpose of receiving wagers and bets on horse races.” Complainant was a fortunate bettor in a number of these events.
