In this appeal we consider whether the trial court erred in dismissing plaintiff’s motion for judgment as untimely filed based on its construction of Code § 8.01-275.1.

Laurie F.S. Waterman filed a medical malpractice action against Sandy (Butler) Halverson, Michelle “Roe” McCormick, Riverside Hospital, Inc., Nancy Couleman, and Paul Rein in the Circuit Court of the City of Portsmouth (the defendants).
