This case returns to us on remand from the United States Supreme Court, which reversed our decision affirming an award of summary judgment in favor of Mark Close, a corrections officer, on a claim brought by Shakur Muhammad, an inmate, pursuant to 42 U.S.C. § 1988. Muhammad v. Close, — U.S. -, 124 S.Ct. 1303, 158 L.Ed.2d 32 (2004). As explained below, we REVERSE the judgment of the district court and REMAND for further proceedings.
