Plaintiffs Jorge Mercado Alicea (“Mercado”) and Angel Nazario (“Nazario”) brought suit under 42 U.S.C. § 1983 against their former employer the Puerto Rico Tourism Company (“PRTC”) and Milton Segarra (“Segarra”), Nelson Cardona (“Cardona”), Jose J. Faz (“Faz”), Mariano Mendez (“M.Mendez”), William Mendez (“W.Mendez”) and Anabel Jaime (“Jaime”) (collectively “defendants”).
