The subject-matter of this action is 160 acres of land, described as the E. y2 of the S. W. % and the S.% of the N. W. y of section 23, township 12 N, range 15 E. This tract cl land was first segregated from the public domain by W. W. Bray, an intermarried Creek citizen, who occupied the same for a period of about 15 years prior to the bringing of this suit. He fenced it, and broke out a portion of same, and placed it in a state of cultivation. ..
