BUFFINGTON, Circuit Judge.

In the court below (156 Fed. 535), Crittenden, the defendant in error, brought suit against William and Theodore Cobb, to recover on a contract between them, which, after arranging for the sale of certain stocks of the same road by Crittenden to the Cobbs, provided for the sale of certain bonds thereof as follows:
